§ 5.2. Local officers compensation commission.

  • The Commission shall consist of five (5) members appointed by the Mayor subject to confirmation by a majority of the members of the Common Council for a term of five (5) years. Members shall be appointed before October 1, of the year [of] appointment. Vacancies shall be filled for the remainder of the unexpired term. Commission members shall be registered electors of the City of Utica. The Commission shall meet for not more than fifteen (15) session days in every odd-numbered year and shall make its determination within forty-five (45) calendar days of its first meeting. The Commission shall determine salaries for elective offices no later than forty-five (45) days prior to filing deadline. The Commission shall determine the salaries of all elected officials of the City of Utica, which determination shall be the salary unless the legislative body of the City of Utica, by resolution, adopted by two-thirds (2/3) of the members of elected, reject same. The determination of the Commission shall be effective thirty (30) days following the filing thereof with the City Clerk unless rejected by the Common Council. A majority of the members of the Commission constitutes a quorum for conducting the business of the commission.
